Samsung demands Apple retrial

Appleand Samsungwill once again square up over round corners and other smartphone design aspects, as a US judge considers whether to overturn or enlarge the $1bn verdict against the South Korean group, writes Tim Bradshaw in San Francisco.

Judge Lucy Koh and legal teams from the two leading smartphone makers will meet in San Jose, California on Thursday to consider arguments, in the most vigorously fought case in the long-running global patent battle.

After a jury found that most of Apple’s asserted patents and its trade dress, or product characteristics, had been infringed, the group is seeking to ban eight Samsung smartphones from sale in the US, ahead of the Christmas trading season. It is also looking for an additional $707m in damages from Samsung for patent infringement and dilution, on top of the $1.05bn it was awarded by the jury.
